What is Legal Metrology Certificate or LMPC?

LMPC is packaging law in India, meant to regulate the packaging requirements of the pre-packaged commodity sale or distribution in India. The food items, pharmaceuticals items or any other items may have specialised requirements in their governing act say pharmaceutical products have to follow additional requirements given under Drugs & Cosmetics Act, 1940. Any importer that imports any pre-packed commodities to distribute or sell, then he needs to apply for the importer registration under rule27 of the Legal Metrology Packaged Commodities Rules (LMPC Rules), 2011. Under this registration, the importer needs to inform to the Government that what pre-packed products he shall be importing in India. The technical name of the LMPC registration is “Importer Registration under Rule 27”, some people call it “Legal Metrology Certificate”, some call it “Importer Registration under Legal Metrology”.  Since this registration is required under the LMPC Rules, 2011 the customs authority popularly called it “LMPC Certificate”.

Type of LMPC Certificate?

There are two kinds of LMPC registrations under the Legal Metrology Pre-Packed Commodity Rules, 2011.

Legal metrology provisions apply to the following:

Individuals that use any weight or measure in any transaction, industrial production, or protection.

Manufacturer, retailer, wholesaler, dealer, repairer of any weight or measure, importer, and/or packer of any weight, measure, or number-related item.

1. Authenticated document regarding Proprietorship/Registered partnership deed/ memorandum of association and articles of association, PAN, TAN, COI along with list of directors in case of company.

2. Premises – ownership documents or leave license agreement or lease agreement along with NOC from the owner

3. Name & logo of the brand along with tag Line

4. Information on the type of product (i.e. cosmetics, food, etc.)

5. Name and quantity of ingredients used in the product

6. Quantity of the product in the package

7. Price of the product

8. Date of manufacturing and packaging

9. Expiry date

10. Nutritional facts/ certificate (Composition of proteins, facts, etc.)

11. Address of manufacturing unit. (if any)

12. Contact details of the business. (For feedback, complaints, information, etc.)

13. Specific instructions for using the product (if any)

14. Food license (if food product)

15. Shop Act license

16. Professional Tax

17. Udyam Registration

18. Self-declaration about whether any offence is pending against you in court or police station

19. Self-declaration about whether the Applicant has violated any of the provisions of Legal Metrology Act, 2009 or rules made there under

20. Latest Light Bill/ Property Tax Paper

POINTS TO BE KEEP ON MIND FOR PACKAGING AND LABELING.

The Food Safety and Standards (Packaging and Labelling) Regulations have set certain norms and standards on how and in which manner the products should be packed and labelled before selling.

Before selling any product, you have to follow certain guidelines on packaging and labelling.

Following are examples of such guidelines: (Which information should be included on the labels?)

Mention “Retail package” OR “Wholesale package” specifically depending on whether the product is packed for retail or wholesale purpose respectively.

Vegetarian products need to have a green mark & non-vegetarian products need to have a red mark on its label or packaging. There are certain specifications for the size of this mark depending on the size of the label or package.

If the product is manufactured & packed by different entities or at different locations;

Mention the detail addresses of both the locations, clearly including survey no., plot no., pin code, etc.

FSSAI Registration and License No. should be displayed on the label or package in the prescribed manner.

Net weight should be mentioned as “Net Wt” & Batch number as “Batch No.”.

The maximum retail price should be written as “Max. Retail Price (Inclusive of All Taxes)”. If your price is dependent on city limits or specific to any geographical region you should mention it clearly for example price “In MUMBAI” and/or “Outside MUMBAI”.

Dates should be written as- “Packaged Date” -DD/MM/YYYY.

Expiry Date should be displayed as follows:

“BEST BEFORE ………. DATE/MONTH/YEAR”

OR

“BEST BEFORE……..DAYS FROM PACKAGING”

OR

“BEST BEFORE ……… DAYS FROM MANUFACTURE”

Ingredients of the products should be written in descending order of quantity of each ingredient. Every ingredient needs to be mentioned.

Nutritional facts should be mentioned for every product which is a mixture/processed (not in natural form).

If the product contains Oil or Ghee, then mentioning Trans-fat is mandatory. There are 8 types of Nutritional facts that need to be mentioned for the products with Oil or Ghee. The type of Oil needs to be written specifically. E.g. Sunflower oil, Groundnut oil, Vanaspati Ghee, etc. Writing the facts in the local language is MUST.

For food products without Oil; mentioning Fats, Proteins, Carbohydrates and Energy is essential. Writing the facts in the local language is MUST.
